Data Protection Guernsey

Dr Peter Harris, Guernsey's Data Protection Commissioner may walk softly but he certainly carries a big stick!

A recent survey, conducted by Guernsey's Data Protection Commission, indicated that many websites do not comply with the Data Protection Commission Law. Websites that collect data on individuals must have a clear Privacy Statement on every published page and, each site owner should be (if not exempt) be Notified with the Data Protection Commission.

Although Dr Peter Harris has given businesses in Guernsey a period of grace to adjust to the new law be under no illusion that the full weight can be applied at any time.

Anyone out there fancy being the test case?

The rules are reasonably simple. If you collect personal data then your company probably needs to be Notified. If you collect personal data then your site needs a Privacy Statement.

Submarine have built a number of e-commerce sites and advise all clients that Notification and inclusion of Privacy Statement are part of the process. As we all know paying advocates vast amounts of money for something they are not generally aux fait with or getting our clients' Compliance Departments to agree to anything can prove, for the former, annoying and for the latter, mind numbing.

To assist Guernsey companies to comply with the Data Protection Law we've produced a Privacy Statement to assist in the process. This document is free of charge and requires no accreditation to Submarine Limited. Contact us and we'll forward one to you.
